The Texas Forest Service has released their report of the
investigation of the cause and origin of the Bastrop
Wildfire of 2011. In the report, the authorities have determined that on September 4, 2011, power
lines maintained by the Bluebonnet Electrical Coop ignited a
dead pine tree that fell on the lines causing the Bastrop
Fire that killed two people and destroyed over 1,500 homes,
and numerous businesses. The Bastrop Complex Fire is
one of the nation's largest fires in recent history and
destroyed over 34,000 acres as well as caused an estimated
over $250,000,000.00 (Two Hundred and Fifty Million Dollars)
in damage.
According to authorities, the fire
ignited as a result of dead and dry pine trees falling onto
power lines maintained by Bluebonnet Electric Coop.
According to Bluebonnet Electric Coop documents, this is a
similar scenario that caused the Bastrop Fires in February
2009. Thus, there is a significant issue as to whether
this fire could be avoided and should Bluebonnet Electric
Coop have been aware of this danger of dead and dry pine
trees on their power line easements and taken steps to
prevent or at least reduce the potential of an electrical
wildfire like the September 2011 Bastrop Fire?
As a result of the 2011 Bastrop Fire,
numerous Bastrop Fire Lawsuits are expected to be filed
including numerous Bastrop Fire Bluebonnet Electric Coop
Lawsuits, Bastrop Fire insurance coverage lawsuits, Bastrop
Wildfire loss of business lawsuits, and Bastrop Wildfire
property damage lawsuits. In fact, some Bastrop Fire
Bluebonnet Electric Coop Lawsuits have already been filed
and many more are expected.

Unfortunately, in the aftermath of a devastating fire, there
are often many fraudulent contractors, insurance adjusters,
builders, and other unscrupulous individuals that attempt to
take advantage of disaster victims and fire victims.
These individuals will often try to undervalue fire damage
or fraudulently take money needed for rebuilding homes or
replacing property lost in the fire. It is important
when dealing with insurance adjusters and contractors after
a fire, to read and understand any contracts or releases
that are given to you.
In dealing with insurance adjusters, it is often best to
make sure that you have a copy of your insurance policy.
Reading and understanding your insurance policy is extremely
important in determining what compensation you may be
entitled to after a fire loss. It is also important to
determine approximately what your fire damages or fire loss
is including all lost personal property, the cost of
demolition & rebuild, and the cost of alternative living
expenses. In doing this, it is helpful to keep
track of all money spent on alternative living expenses,
demolition, and rebuild. Try to keep receipts for
everything.
It is also often a good idea to let the adjuster originally
state what the coverage and fire loss damage estimates are
prior to stating what you have determined the coverage and
fire loss damage is. Like any negotiation,
having the adjuster state the first number and then
responding to that number is often an effective method of
negotiating an insurance claim.
In dealing with builders and contractors,
it is important to make sure that you are dealing with
someone that will provide good quality work and will finish
any work in a timely manner. As such, it is important
not to agree to give too much money to any builder or
contractor upfront, make sure that they are a legitimate
builder with references and insurance, and to read as well
as keep a copy of any building contract.

Austin Texas Home Fire
Lawsuits and Bastrop Wildfire Home Lawsuits
(The Importance of Working Smoke Detectors and Early
Warnings to Prevent Fatal House Fires)
A working smoke alarm on every level of a
home and in each bed room is an important safety feature to
have in your home. The United States Fire
Administration provides information on smoke alarms
including the following brochure on
What You Need to Know about Smoke Alarms as well as
information on defective smoke detectors that you should be
aware of and avoid.
Defective smoke detectors and smoke
alarms are especially problematic for fires that occur at
night, when people are sleeping, when people are disabled,
or when the fire is hidden. This is because a failure
to warn of a fire can allow the fire to spread. Once
the fire has spread smoke can accumulate taking away oxygen
and creating toxic fumes that can cause people and pets to
pass out from smoke
inhalation.

Recovering
from a home fire, can be difficult. Not only
is there the loss of life or serious injuries to deal with,
but the actual clean up and rebuilding. From the
fire damage to smoke and fire suppression
damage, residential fires typically
require significant resources to clean up and rebuild the
home. As such, it can be extremely difficult to
deal not only with the loss of life, injuries, and damages, but to also deal with the builder,
insurance company, or other large company that may be responsible
for the home fire.
It is often beneficial to hire a home
fire lawyer or fatal fire lawyer to assist in seeking compensation for
a
home fire. A good residential
fire lawyer will investigate the cause of the fire and work with fire cause and origin experts to
determine the cause and origin of the fire.
This investigation is extremely important as it is the
person seeking compensation that has the burden to prove
what caused the fire including poor maintenance on power
lines; faulty installation of
electrical wiring, appliances,
gas lines, or gas meters;
defective parts including aluminum wiring, defective gas meters, defective
gas lines, defective gas control valves, or defective
flexible gas connectors; or defective appliances or vehicles. It is also important to
determine if there were working smoke detectors or flame
detectors in the home.
Texas Fatal Electrical
Fire Lawsuits, Austin Deadly Aluminum Wiring Home Fire
Lawsuits, Deadly Power Line Fire Lawsuits, and Deadly Fire
Lawsuits
After
losing a loved one in an accidental fatal fire, it can be
difficult to locate all potential insurance recoveries as
well as to prove to insurance companies and guilty
defendants the full extent of damages that your family has
suffered. This is true even if the damages suffered include
the loss of a main contributor of financial support to your
family or if there are large medical and funeral bills
created by the death. These damages can cause a ripple
affect of other damages that can result in the loss of a
home, loss of vehicles, loss of ability to go to college,
and other serious financial problems.
This investigation is often hard for the
family of the person that was killed in the fire because
they are unfamiliar with fire investigation and they are
usually busy grieving the loss of their loved one.
They also are often attempting to transition into a world
without their loved ones and dealing with financial and
probate issues.

(Poor Maintenance on Power Lines, Aluminum Wiring & Defective Smoke Detectors: Increase
Risk of Fatal Home Fires and Devastating Wildfires)
Poor maintenance on power lines as well
as defective aluminum wiring can cause devastating
electrical fires such as the
Bastop Wildfire of 2009, Bastrop Wildfire of 2011, the
Steiner Ranch Wildfire of 2011, and many apartment,
condominium, and home fires throughout Texas.
Preventing future electrical fires can save lives and
prevent devastating fire damages. By being aware of
potential hazards such as dead pine trees and branches near
power lines and defective wiring, will allow precautionary
measures such as removing potential dangers and ensuring
that during dangerous conditions proper monitoring is in
place.
Many
older homes including apartments, houses, and condominiums
built in the 1960s and 1970s have aluminum wiring.
According to the United States
Consumer Product Safety Commission, these homes have an
increased risk of fire hazard as aluminum wiring can
overheat and cause a fire. This can turn into a fatal
fire if the home does not have a working smoke
detector. This deadly combination can allow an accidental
electrical fire in the wall of a home to spread undetected and cause
smoke inhalation, serious burns, or even death.
Defective smoke detectors and smoke alarms are especially
problematic because the hidden fire can rapidly spread while
people are sleeping allowing smoke to fill up the home
causing people and pets to pass out from smoke inhalation.
If you own or are thinking of buying or renting an older
home it is important to know if you have aluminum wiring and
if your home has working smoke detectors. This
knowledge can help avoid a fatal house fire or fire tragedy.
When purchasing, renting, or deciding to
live in an older home it is important to know when it was
built and if it was built with aluminum wiring in it.
This is because many homes built in the 1960s and 1970s were
built with aluminum wiring that can over heat and cause a
fire. Additionally, over time the aluminum wiring in
these homes typically deteriorate making the risk of an
accidental electrical fire increase.
If you own or are thinking of buying or
renting an older home it is important to know if you have
aluminum wiring. If your home will have aluminum
wiring, it is also a good idea to review the
Consumer Product Safety Commissions Recommendation for
Aluminum Wiring in Homes and to make sure that your home
has working smoke detectors. This knowledge can help
avoid a fatal home fire or fire tragedy.
As for power lines during droughts, dry
and windy weather, it is important to identify and report
dead limbs and trees near power lines that could cause a
fire. It is also important to keep a record of the
report and follow up with the proper utility to make sure
that any potential fire hazard is properly taken care of by
the utility.
