Product Liability Claims (Defective Cribs, Playpens, and Bassinets)

Recent lawsuits have been filed against manufacturers of defective cribs, bassinets and playpens that create hazards for infants and young children.  Some of these products have dangerous defects that can cause infants to become trapped and suffer strangulation.

There have been recalls of cribs and bassinets involving manufacturers that produce different types of problematic hardware used on cribs sold from 1995 through 2005. The hardware includes safety pegs for one type of cribs and spring pegs for another.  Either can create a hazard if not properly installed. The drop side of the cribs can fall and disengage, creating a gap that can entrap and suffocate infants.

It is important to check the U.S. Consumer Product Safety Commission to make sure that the toys, car seats, food, and cribs that you are buying are safe and have no known safety defects.

Product Liability Claims (Lead-Tainted Toys and Children's Products )

Lead-tainted toys and children's products can also create hazards for small children.  As such, there have been several recalls of toys and children's products that contain lead-levels in excess of allowable amounts. Some of these lead-tainted items range from toys to products children put directly in their mouths, such as baby pacifiers.

Other potential dangerous toys and recalls are listed on the Consumer Product Safety Commission's website.  A recent recall includes toys which contain magnets in small flexible parts of the animals, vehicles and building sets that can detach. Magnets found by young children can be swallowed or aspirated. If more than one magnet is swallowed, the magnets can attract each other and cause intestinal perforations or blockages, which can be fatal.

Product Liability Claims (Defective Food Products)

Imports from China have been in the news as food products including human and pet food have been tainted with dangerous chemicals.  As imports have become more common safety regulations of foreign product have become an increasing concern especially with food products and toys for infants and young children.

In a recent scandal, milk products from China were shown to be dangerously defective as studies revealed that babies fed formula made from powder tainted with a toxic chemical called melamine had developed kidney stones. At least four babies have died and at least 53,000 other children have fallen ill, according to reports from official news agencies. The government concluded that melamine was being added illegally to watered-down milk to raise its apparent protein count.  In response to these dangerous products, there were product recalls and export bans around the world.

Since this discovery, a wide range of food products from China have been discovered to contain melamine, including those made with milk products, like yogurt and cookies, prompting countries around the world to recall Chinese-made food products.

More recently, tainted eggs have been found, raising the possibility that chicken feed was being doctored. In Hong Kong, government officials on Wednesday reported finding another batch of eggs imported from mainland China that had high levels of melamine. The announcement came days after two other tainted batches were reported.

It is important to check the U.S. Consumer Product Safety Commission to make sure that the toys, car seats, food, and cribs that you are buying are safe and have no known safety defects.

Product Liability Claims (Dangerous Drug Claims)

Dangerous and defective drug claims have become more common as the pharmaceutical industry has become more powerful.  With large drug companies investing hundreds of millions of dollars in developing new drugs, the businesses and people whose careers are built on the success of these drugs sometimes choose to ignore or hide research that shows certain drugs are dangerous.  At other times overzealous marketing teams get control of a drug and in an attempt to expand revenues and maximize profits extend the uses of a drug beyond what is safe.
